Terms of service

These terms are the agreement between GoSmash (gosmash.cc) and the venue that uses it. They are written to be read: if something is unclear, email support@gosmash.cc and we will explain it. By creating a venue on GoSmash, or by using it, you agree to these terms and to our privacy notice.

1. What GoSmash does

GoSmash is booking software for courts and ball machines: a venue page where players see free slots and book, an owner schedule, receipt approvals, reminders and, on GoSmash Pro, an AI booking agent for chat, online payments, reports, team logins and open play. What each plan includes is listed on the pricing page.

On GoSmash Pro, an AI agent answers your chats and books slots using the information you gave us. Prices, availability and double-booking checks are done by our booking system, not guessed by the AI. Still, an AI can misunderstand a message or word a reply badly. Every conversation stays visible in your chat inbox, you can take over any chat at any time, and the agent hands chats to your staff when it is unsure. Please look through your chats from time to time, and tell us when a reply was wrong so we can fix it.

If GoSmash Pro is not right for your venue, email support@gosmash.cc within 30 days of your first GoSmash Pro payment and we will refund that payment in full.

8. Fair use

Don't use GoSmash to break the law, to send spam, to mislead players, to collect data you have no right to, or to try to break into, overload or copy the service. Use the AI agent for your venue's bookings and questions, not for unrelated work.

9. Your content and data

Your venue details, photos, prices, rules and booking records belong to you. You let us store, show and process them only to run GoSmash for you, for example to show your page to players and to let the AI agent answer from them. We don't sell your data or your players' data, and we don't use it for advertising. How we handle personal information is in the privacy notice.

10. Keeping GoSmash running

We work to keep GoSmash available and back up booking data every day. Like any online service it can occasionally be down for maintenance or because of a problem with our hosting or another provider. We will fix problems as fast as we can and tell you about longer outages. We improve GoSmash all the time; if we ever remove a feature you pay for, we will tell you in advance.

11. Other services

Some features rely on other companies: Meta for Messenger and Instagram, PayMongo for online payments, OpenAI for the AI agent, and our hosting and email providers. Their own terms apply to your use of their services, and we are not responsible for their outages or decisions, such as Meta changing what apps may do with a Page.

12. Liability

We provide GoSmash with care, but as far as the law allows, we provide it "as is" and can't promise it will be free of errors. We are not liable for indirect losses such as lost bookings, lost profits or lost data that a backup could not restore. If we are liable to you for anything, our total liability is limited to the amount you paid GoSmash in the 3 months before the claim. Nothing in these terms limits liability that the law does not allow us to limit.

13. Changes to these terms

If we change these terms in a way that matters to you, we will email the owner of each venue at least 14 days before the change applies. The date at the top of this page shows the latest version.

14. Law

These terms are governed by the laws of the Philippines, and disputes go to the courts of the Philippines. Before that, please write to us: most problems are solved with one email.
